- Hi, we’re Codelbee and welcome to our acceptable use policy. This policy sets out what you can and cannot use our sites and products for.
- When we say ‘we’, ‘us’ or ‘Codelbee’ it’s because that’s who we are and we own and run Milkshake. If we say ‘policy’ we’re talking about this acceptable use policy. If we say ‘user terms’ we’re talking about the rules for using any of the Codelbee products and services. Take the time to read this policy because it forms a part of the user terms for each of the Codelbee products. By using any of our sites, you agree to this policy. If you do not agree to this policy we won’t take it personally, but please do not use Codelbee.
So what’s not acceptable use?
-
It’s NOT OKAY to use Codelbee or any of our sites, services or products to submit, post, build, host or otherwise make available any content that may contain, provide access to (eg, through links to third party websites) or promote any of the following content:
- Adult content: This includes images or videos that contain nudity or sexual activity, or any commercial activity linked to making money from adult content such as escort agencies.
- Exploitation of children: This includes images or videos depicting children in a way that encourages or promotes attraction towards children.
- Self harm: This includes but is not limited to content that promotes hurting yourself, suicide and disordered eating.
- Hate speech: This includes content that supports or condones violence or discrimination against individuals based on race, ethnicity, religion, disability, age, gender, nationality, sexual orientation or gender identity. This includes content that promotes or idealizes perpetrators of hate speech.
- Incitement of violence: This includes content that threatens, or that is intended to incite, violence against an individual or group of individuals.
- Harassment: This includes any form of harassment or bullying against an individual or group of individuals.
- Defamation: This includes any untruthful comments about a person that has the tendency to lower their estimation in the eyes of others.
- Copyright and third party intellectual property: Using the Codelbee sites, products or services in violation of the copyright or other intellectual property rights of others is NOT cool, and is illegal, so please don’t do that.
- Offensive/shocking or violent content: This includes content that would cause offense to a reasonable person, including content that is posted for shock value.
- Spam/fraudulent content: This includes making statements about your own products or services that are not accurate. Using fake or disposable email addresses and engaging in phishing or linking to sites that engage in phishing.
- Misinformation, misleading or deceptive conduct: This includes impersonating other people, organizations or groups. Misrepresenting your affiliation with others. Posting content that is intended to misinform others.
- Supply of regulated goods and services: This includes the supply of weapons, gambling or adult escort services.
- Goods and services restricted by our payment providers: When you use Milkshake’s payment features to sell digital files, text notes, links or other items, you must comply with the acceptable use policies of our payment providers. In particular, you must not sell anything that appears on Stripe’s list of restricted businesses, available at stripe.com/restricted-businesses. This applies both to content hosted on your Milkshake Website and to anything delivered to a buyer via a link, file or text note sold through the Service.
- Illegal activities: This seems like a no brainer but using Codelbee, products or services for any dangerous or illegal content or other purposes is NOT acceptable. You should always ensure you’re aware and comply with any applicable laws in Australia, USA or other jurisdictions you are located in or doing business in.
- Illegal activities which cause harm to Codelbee products or services or brand or others: Unacceptable content or links which might cause harm to the Codelbee products or services or brand or others is definitely NOT OKAY with us. This includes pirated software, programs or archives that provide the functionality to gain unauthorised access to other systems or networks of any kind, Warez sites, files or web pages that contain viruses, trojans, malware or other applications designed to access a user’s equipment or information with illegal intentions and/or without the knowledge of the user. You must not modify, reproduce, display, publish, distribute, copy, transmit, perform, license, create derivative works from, transfer, or sell or re-sell any information, content, software, or item obtained from or through Codelbee sites, services or products, other than in accordance with these terms or the license for the item.
-
Codelbee is founded on the idea of community and like any functioning and healthy community, some things are not allowed and are NOT OKAY. It’s NOT OKAY to:
- attempt to gain unauthorised access to computer systems or content through the Codelbee sites, service or products;
- attempt to contact other members through the Codelbee sites, services or use any information gained from the Codelbee sites or services with the intention to make a private arrangement that would otherwise be made using the Codelbee sites, services or products;
- enter any arrangements that are not consistent with, or are intended to apply in addition to these terms;
- use information gathered from or through the Codelbee sites, service or products in a way that may confuse or mislead consumers (for example, automatically gathering information to set up a site that looks like one of our sites);
- use or permit the use of any automatic device or program, or manual process to monitor, copy, or scrape Codelbee’s sites, pages or products or the content or data contained in them;
- attempt to or actually interrupt, negatively impact or alter the Codelbee sites, service or products operation in any way.
What you can’t sell or charge for
-
The restrictions in this section are in addition to those in section 3 above and apply when you use Milkshake’s payment features (including selling digital files, text notes or links, or accepting tips). It is NOT OKAY to use the payment features to sell, take payment for, or accept tips for any of the following:
- Adult or sexual content — including digital files, even if you are not also hosting that content on your Milkshake Website.
- Weapons — including firearms, parts, ammunition, weapon schematics or 3D-printable firearm files.
- Drugs and tobacco — including illegal drugs, prescription or regulated medications, drug paraphernalia, vape products, tobacco and direct sales of alcohol.
- Gambling — including bets, lotteries and sports-betting picks or tips sold for money.
- Counterfeit, pirated or IP-infringing goods — including replica or “dupe” branded items, cracked software, pirated media or courses, and stock photos, fonts, music or code you don’t own or licence.
- Goods or services requiring a licence you don’t hold — including financial advice, legal advice, medical advice and other regulated professional services.
- Personal data — including mailing lists, scraped contact databases and doxxing files.
- ID documents and forgery tools — including fake ID templates and document-forgery kits.
- Multi-level marketing, pyramid schemes and “get rich quick” products.
- Hacking and malware tools — including credential lists, exploit kits and any program designed to gain unauthorised access to systems.
- Hazardous, recalled or stolen items.
- Unregistered securities and unlicensed financial products — including cryptocurrency “signals,” investment groups and pump-and-dump schemes.
- Anything illegal in your jurisdiction or your buyer’s jurisdiction.
- Anything appearing on Stripe’s list of restricted businesses — Stripe’s list applies to your sales in addition to this policy and may be broader in some areas.
-
It is also NOT OKAY to:
- Launder transactions — using your Milkshake Website to process payments for a different, undisclosed business.
- Mismatch what you sell against your Stripe business profile — only sell items consistent with the business and nature of products you described to Stripe during your Stripe onboarding. If what you sell changes materially (for example, you onboarded as a digital-art creator and start selling something in a restricted-business category), update your Stripe profile first.
- Make false or misleading claims about products, results or outcomes — including for courses, coaching, supplements or financial guides.
- Use fake testimonials or reviews.
- Skip required disclosures — including for affiliate links, sponsored content or gifted products under the law that applies to you.
- Bait and switch — what is delivered must match what was described before purchase.
- Disguise sales as tips or donations, or use Milkshake for fundraising or charity — tips on Milkshake are voluntary contributions to you, the seller. They must not be used to gate access to digital goods, take payment for anything that would otherwise breach this policy, or be described to your buyers as charitable, tax-deductible or “donations” to a registered charity. Milkshake’s payment features are not available for charitable, nonprofit, fundraising or crowdfunding activity, whether on your own behalf or on behalf of a third party or cause. Stripe separately treats this activity as a restricted business — see Stripe’s list of restricted businesses.
- Direct buyers off-platform to evade fees — using Milkshake’s payment features (including a low-priced item or tip) primarily to direct buyers to an external checkout in order to avoid our platform fee.
- Test cards, run artificial transactions, inflate volume or commit any other form of payment fraud.
